In August 2017, Western Cape High Court judge Dennis Davids found a ban on the use of dagga at home to be “against the constitutional right to privacy”. Judge Davids ruled that cannabis be legalised for home use. The case was brought forward by Garreth Prince and IQELA LENTSANGO: The Dagga Party of South Africa leader Jeremy Acton. The Constitutional Court had 24 months to announce its judgement on the court’s ruling. In the interim, the WC High Court ruled that those found in possession of marijuana, for personal use in their own homes, would be able to use the defense of invasion of privacy against any charges.

Just over a year later, the South African Constitutional Court ruled that marijuana has been legalised for personal use. https://www.marieclaire.co.za/latest-news/marijuana-legalization-in-south-africa

By South African law, Marijuana has been decriminalized but, dealing marijuana, selling it on to others or smoking it outside the confines of your own home remains an illegal practice.. So essentially, it is okay for private use and enjoyment in your private space

Is the recent legalization of marijuana in South Africa the right call to make and should more countries legalize its private use?

I'm all for it. Its non-addictive, It is NOT a gateway drug, Its much much safer than alcohol and tobacco. Rates of alcohol related diseases such as cancer and cirrhosis would drop if people substituted cannabis for alcohol, Has medical uses. Its effective for pain - this I know. It Is non-toxic. Seriously! There is no amount you could smoke or eat that would harm you. Drinking too much water can kill you.

YES Marijuana can be used to help people cope with mental and physical illnesses. My cousin, who has had severe depression his entire life, uses weed to cope with it. I don’t know what condition he would be in if he didn’t use it. He is a very, very troubled man and marijuana has helped him a lot

ALL or MOST of its harms are attributed to the black market. If cannabis was legal the black market would mostly vanish.

Marijuana, when compared to other illegal drugs, is not nearly as addictive, damaging to health, and you can’t overdose on it. Unless you can consume a ridiculous amount of weed in a ridiculously small window of time, then you won’t die from overdose. That sets it very far apart from other drugs. Marijuana is not an intense drug.

Marijuana is a gateway drug but wouldn’t be if it were legal. If you asked the average drug user how they got introduced to drugs, it’s very likely they would say they started with weed, then proceeded on to more powerful and addictive drugs.

The people who consume Marijuana has no intention of harming anyone. They just enjoy their time. And what do the ‘authorities’ do? They arrest them for enjoying their time. Just legalize it

The better question is,"Why shouldn't it be legal?" The default state of anything is legal, so the burden of the proof is on the side of folks who want to make it illegal.
